Terms of use — draft
Draft for the owner’s review. These terms describe what the product does and does not do, in the words the product already keeps to. They are not final and they are not legal advice; the owner and her counsel decide what stands.
1. What the service is
Possena reads a résumé, a job posting and the facts you give it, and writes application documents from those facts alone. Every employer-facing claim traces to a fact you provided or confirmed; scores are computed in code from fixed rules; nothing about you is invented. A score is weighted evidence coverage — not interview probability, not an ATS pass rate.
2. Your account and your data
You may start without an account; what you do before signing up is kept for you and claimed by your account exactly once when you sign up. Your data is stored in private, owner-scoped storage and read only under your own access rules. You can export everything the account holds at any time from Settings, and you can ask for your account to be deleted: career and voice content is erased after a 24-hour window in which you can cancel; records of payments and Job Credits are retained for audit with your account reference.
3. What stays private
Work authorization, weaknesses or frictions you note, sensitive reasons for transitions and anything you say by voice are private unless a rule you can read permits their use. A weakness you declare is never turned into a statement to an employer. Assessment reports you upload are read as private work-style signals, never as proof of capability. No recording of your voice is ever stored — only the transcript, which you confirm before it becomes a fact.
4. Uploading is the agreement
When you upload a document or type a fact, you are asking the service to use it to write your documents. Facts from your own sources are usable in the documents written for you by default; you may keep any fact private with one click, and that choice is honoured everywhere. The service’s obligation is to use only what you gave it and to invent nothing.
5. Organizations
An organization that sponsors your access sees administration — membership, invitations, its credit pool — and nothing of your career unless you share one application with it yourself. You can stop sharing at any time. Your profile stays yours and portable.
6. Job Credits and payment
Your first complete application pack is free, once. After that, one unique job costs one Job Credit for its complete cycle, every revision included; nothing is charged per model call or per document. Prices are shown in U.S. dollars. Payment, when connected, runs through a payment processor; the ledger of your credits is kept by the service and every entry is permanent — a correction is a new entry, never an edit. Refunds are recorded as compensating entries.
7. Refunds and cancellation
Application packages you buy do not expire and do not renew: they wait for you, and nothing is taken again unless you ask. Automatic top-up is off unless you switch it on. A subscription is monthly or yearly, you can cancel it in one click, and it runs to the end of the period you have already paid for. Every credit and every refund is a permanent entry in your ledger — a correction is a new entry, never an edit — so what you were charged and what you were given back can always be read back.
Two things about refunds are the owner’s to set and are listed in §11 rather than guessed at here: how long after a purchase unused packages can be refunded, and whether a cancelled subscription is refunded for the unused part of a period or simply runs out.
8. Discord
The public /jobcheck command reads a public job posting and returns job intelligence only. Nothing about you enters Discord; matching against your own profile happens only after you continue into the private web app through a signed, short-lived link.
9. Referrals
A referral counts once, at sign-up, and never for yourself. Any referral reward is ledger-backed and is credited only after the person you invited makes a qualifying purchase that clears the refund period; a refund reverses it.
10. What we do not promise
The service does not guarantee an interview, an offer, or a response from any employer. It does not claim to see every job posting. It does not decide whether you are able to do a job; it shows what your materials support and what they do not.
11. Open for the owner’s review
Governing law and jurisdiction; the legal entity; the applicable privacy statutes (Quebec Law 25, PIPEDA, and U.S. state law) and their specific obligations; dispute resolution; the effective date; the refund window for unused packages; and whether a cancelled subscription is refunded pro rata or runs to the end of its period. None of these is written here, deliberately — and the last two are the ones a payment processor asks for before it lets a live card through.
